Plant variety protection ensures the legal protection of improved plant varieties (hybrids, lines, clones etc.). Plant variety protection may be granted for varieties of all botanical genera and species.

Under certain conditions the three-dimensional structure of micro-electronic semiconductor products can be protected.

Application/Procedure

The written application shall contain

  • a request for registration of protection
  • description of the topography
  • material identifying or illustrating the topography

 IP rights for semiconductors are granted without prior examination (in a similar way as for utility models). It is only upon a request for cancellation, which may be filed by any person, that their protectability is examined.

 

Cost 

The fee for registering a topography is € 300.

 

Renewals 

There are no renewal fees to be paid for topographies.

Topographies are valid for 10 years from the earlier of the following dates:

– the end of the calendar year during which the topography is first commercially exploited anywhere in the world (if the application for registration is filed with the Austrian Patent Office within 2 years)

– the end of the calendar year during which the application for registration has been filed with the Austrian Patent Office.

 

The Supplementary Protection Certificate (SPC) aims at extending the term of protection of a patented medicinal product in the framework of a sui generis title of protection. Protection can be extended by the certificate for a further period of up to five years.

The application for a supplementary protection certificate shall be filed within 6 months of the date on which the authorisation to place the product on the market as a medicinal product was granted and where the authorisation to place the product on the market is granted before the basic patent is granted, the application for a certificate shall be filed within 6 months of the date on which the patent is granted.
