The patent office provides free access to the Estonian Patents, Trademarks, Designs and Geographical Indications databases. Access to these databases can be found at www.epa.ee

Enforcing IP Rights

If your intellectual property rights are intentionally infringed on a commercial scale, there may be the possibility of prosecuting that person. If you do not manage to solve the dispute directly with this person, it is better to contact an attorney. In case of infringement industrial property rights it is advisable to contact a registered patent attorneys – see the list at www.epa.ee. Please notice that patent attorneys have field of activity (patents and utility models or trademarks and designs).

Any infringement of IP right-holders’ exclusive rights can be, in principle, considered as criminal offence. Criminal proceedings may be initiated either ex officio (e.g by the police) or on the basis of the right holder’s application. Punishments depend on a scale of the offence. In cases where an infringement can be considered insignificant, the authorities may choose not to initiate (or terminate) criminal proceedings. However, the right-holder is always entitled to initiate civil proceedings (request of termination the infringement, compensation of damages, etc.). In addition, where goods infringing an IP right are being imported into Estonia from a third country (i.e. a country outside the European Economic Area), it may be possible to ask customs authorities to seize the illegal goods. The customs authorities may also impose fines on importers who have imported infringing goods to the country.

Appeals
If you are not satisfied with a decision of the Estonian Patent Office (even being a third party), you can make the appeal at a cost of 2500 EEK (about 160 €). The Board of Industrial Property Appeals (BoA) works at the Ministry of Economics and Communication – see their website (in Estonian only). The BoA resolves disputes concerning industrial property objects (trade marks, patents, etc.). The BoA has no competence to solve disputes concerning the use of industrial property objects. Those disputes belong to the competence of civil courts.
  
Through the Copyright CommitteeThe Copyright Committee is an expert committee that inter alia resolves, at the request of the parties, disputes related to copyright and related rights by way of conciliation of the parties. In conciliation proceedings, the committee shall make a proposal to the parties to resolve the dispute and enter into an agreement. The parties may, within three months as of the receipt of the proposal, present their positions expressing consent or opposition to the content of the proposal. Failure to present a position shall be considered as consent to the proposal. If the parties consent to the proposal, the committee shall approve the agreement and notify the parties thereof in writing. Performance of an agreement approved by the committee is mandatory to the parties and it may be submitted to a bailiff for enforcement pursuant to the procedure provided by the Code of Enforcement Procedure. If the parties fail to consent to the proposal, the applicant withdraws the application or the other party refuses to participate in the conciliation proceedings, the committee shall state the failure to reach an agreement and shall notify the parties thereof in writing.
