Step 1 | To submit an application for a utility model, the applicant must present the following to INPI, in Portuguese:
In case of not being established in Portugal you can still act directly to INPIs services by indicating an address in Portugal, an e-mail address or a fax number in order to receive notifications.

Step 2 | In Portugal, it is possible to apply for two types of utility model: either with or without an examination. The examination involves an investigation into whether the invention fulfils the patentability requirements: novelty, inventive step and industrial application. It is not compulsory to request an examination for a utility model. The examination only becomes compulsory if you intend to initiate legal proceedings. An examination can be requested:

Step 3 | Go to INPI’s website at www.inpi.pt and click on the INPI Online menu [Patents – Filing].

Step 4 | Once a utility model application is filed, it is submitted to a formal examination and then published online in the Industrial Property Bulletin 6 months after the filing or priority date. At the time of filing, or even later, the applicant can request the publication to be anticipated, or postponed (up to a limit of 18 months after the filing or priority date).

Step 5 | Following the publication of the application, a two-months opposition phase begins, during which anyone who considers themselves harmed as a result of the grant can file a complaint.

Step 6 | Once the opposition phase has come to an end (or a complaint has been filed), the application is submitted to an examination (except in the case of an utility model application in which an examination has not been requested, and no complaint was filed).

Step 7 | The conclusion of this process is the notification of grant, refusal, or partial grant, issued accordingly. The duration of a utility model is 6 years, starting from the filing or priority date, but this period can be extended. During the final six months of the validity period, the owner can request an extension for a period of two years, and during the final six months of this supplementary period, a second and final request for extension of the protection period can be made, again for a period of two years.

Step 8 | Decisions issued by INPI are subject to appeal at the Intellectual Property Court, in the two months that follow the publication of the decision in the Industrial Property Bulletin. The Court of Arbitration which works in conjunction with the Arbitration Centre, ARBITRARE, is able to appraise the appeals from INPI’s decisions that are submitted within a two-month deadline, represents an alternative to the law court. To keep your utility model in force Renewals fees must be paid.
Renewal fees have to be paid annually. Renewals should be requested during the final six months of the validity period. If a renewal request is submitted after this period (but no longer than six months later), an additional fee is due.
