Enforcing your patent

If a patent owner discovers that someone else has made use of the invention as described in the patent and the patent owner has not given his consent for this, such an act constitues an infringement of the patent.

The patent owner may start infringement proceedings, eventually ending up in court.

When the of infringement accused party may feel that the patent does not meet the requirements as stipulated in the Patent Act, he has the option of trying to have the patent declared ‘invalid’.

Nullification proceedings are worth considering.

 

All patent procedures in The Netherlands are brought before the District Court of The Hague, in interlocutory proceedings if necessary. The Court can obtain an advice by the Netherlands Patent Office.
