Topographies of semiconductor products

 

 Three-dimensional structures of microelectronic semiconductors (topographies) are eligible for protection, similar to inventions. These IP rights for semiconductors are granted without prior examination. It is only upon a request for cancellation, which may be filed by any person, that their protectability is examined.

 

The written application shall contain

 – a request for registration of protection

– material identifying or illustrating the topography

Formalities

Applications can be filed for SPCs for pharmaceutical or for phytopharmaceutical products. The application must contain at least:  

– an application form (2 copies) mentioning :

  • the name and address of the applicant;
  • the name and address of attorney or any representative, if appointed;
  • the number of the basic patent; the name of the product;
  • the date and the number of the first marketing authorization in The Netherlands;
  • the date, the number and the state of the marketing authorization in the EC if the Dutch marketing authorization is not the first in the EC;

– a power of attorney or any representative, if appointed;

– a copy of the first marketing authorization in The Netherlands;

– a document identifying the first marketing authorization in the EC, if necessary.

Fees

The filing fee is 544 Euro.

Annual renewal fees are depending of the duration of the SPC and the renewal fee to be paid. See our list of fees .
